Rights Granted by you – Media Release: By agreeing to these terms you understand that California IVF Fertility Center (the Center), anyone acting on its behalf, or its respective licensees, affiliates, successors and assigns will have the right, where permitted by law, without any further notice, review or consent, to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, your entry, including, without limitation, your name, portrait, picture, voice, likeness, image or statements about the promotion, biographical information and other Protected Health Information from you, the Center or from other incidental providers, as that term is defined by state and federal law, as news, publicity or information and for trade, advertising, public relations and promotional purposes without any further compensation.
The Center is a HIPAA covered entity. The fertility awareness promotion project is intended to bring awareness by releasing individual stories to the public. This includes entry videos and any additional videos and photographs taken in relation to the free IVF cycle. You must agree to release all rights for Center to promote fertility awareness, including but not limited to future videos and the potential assembly of a multi-part documentary intended to promote fertility awareness and services provided at the Center. Submission videos, video interviews, and recordings of the treatment process will become the property of the Center with your unrestricted license for use. The Center agrees that all winners and patients will be portrayed respectfully and avoid the recording or use of inappropriate content (that is, portraying only what could be shown on public TV). The information released by the Center in response to this authorization may be re-disclosed by the recipient to other parties. This authorization may be revoked in writing at any time except to the extent that the Center has already acted in reliance on your authorization.
By agreeing to the terms, you are noting to be aware that the Center may benefit from this promotion both monetarily, or otherwise, and you release any claim to any future benefit or income that results from your participation in the promotion. The Center and its affiliated advertisers have your permission to use the photographs, videos, and media you submit.
